The work involved an in-depth analysis of the current environmental legislation, comparative analysis of several foreign countries' legislation, and analysis of judicial practice. The research allowed identifying numerous controversies in the legislation and law-application practice and proposing the ways to address these. The environmental legislation reform concept and the draft law to amend certain normative legal acts of different levels, as well as other supporting documents have been prepared.
The project took several months of painstaking and intense work in close cooperation with environmental experts and other specialists of largest active enterprises, independent environmental organizations and other governmental agencies and public associations. As a result, the firm's experience in the field of environmental regulation has been substantially enlarged and enriched. In particular, we have acquired vast knowledge in the applied disciplines and the current environmental legislation application practice and judicial practice in different regions of Kazakhstan.
The results of our work were presented at the Environmental Forum held in Astana on 30 May 2013, which was attended by more than 200 representatives of production companies, nature user professional associations, research institutions, practicing ecologists, governmental agencies and law firms.
AEQUITAS was one of the Forum organizers and presented there its concept of environmental legislation reform and the keynote report. In particular, the report touched upon nature users' liability for breaching environmental legislation, environmental harm compensation, environmental permit issuance procedure, industrial and consumption waste management, and other issues. Following the Forum, the RK Ministry of Environment set up a working group transferring to it the set of prepared draft normative legal acts and the required supporting documents.
